1. Who we are
getelemental.ai and the Elemental services are provided by Hectar Global Pte Ltd, a company incorporated in Singapore (“Hectar Global”, “we”, “us”). Elemental Trade Intelligence is operated by Hectar Global Pte Ltd. Elemental is a brand and product name, not a separate legal entity. By using this website or our services you agree to these terms.
2. What Elemental provides
Elemental provides intelligence and decision support for physical commodity trade. It assembles transaction records from the contracts and documents provided to it, analyses that evidence, and presents conclusions together with their basis and their limits.
Credit and funding decisions remain with the financing institution at all times. Nothing Elemental produces is a credit decision, a recommendation to enter into or decline a transaction, or an approval of any counterparty.
3. What Elemental is not
- We are not a bank, lender, financier, broker, insurer or trading counterparty, and we do not provide credit or funding.
- We do not provide legal, tax, accounting, financial or investment advice. Elemental output is not a legal opinion on any contract.
- We do not verify the authenticity of documents provided to us, or the identity or solvency of any counterparty, unless expressly agreed in writing.
You remain responsible for your own due diligence and for every commercial and credit decision you take.
4. Accuracy and limits of the analysis
Elemental’s conclusions depend on the documents and information provided to it. Where the available evidence cannot settle a question, Elemental is designed to say so rather than to assert a conclusion. Output may nonetheless contain errors or omissions, and it is provided on an “as is” basis without warranty of any kind, express or implied.
5. Access to the services
Access to the Elemental underwriting workspace is granted to institutions by invitation and is subject to a separate written agreement, which prevails over these terms in the event of a conflict. Elemental Trade Assurance is offered over WhatsApp; message and data rates from your provider may apply, and your use of WhatsApp is additionally governed by Meta’s own terms.
6. Acceptable use
You agree not to:
- submit documents or information you are not entitled to share, or that infringe a third party’s rights or a duty of confidentiality;
- use the services for any unlawful purpose, including sanctions evasion, money laundering, or trade in prohibited goods;
- attempt to gain unauthorised access to the services, or interfere with their operation; or
- scrape, resell or redistribute Elemental output as your own product without our written agreement.
7. Your content
You keep ownership of the documents and information you send us. You grant us a limited licence to process them in order to provide the services to you. How we handle personal data is set out in our privacy notice.
8. Intellectual property
The Elemental name, the website, and the software, methods and presentation behind the services are owned by Hectar Global. Nothing in these terms transfers any of those rights to you.
9. Liability
To the maximum extent permitted by law, we are not liable for any indirect or consequential loss, or for loss of profit, revenue, business or anticipated savings, arising from your use of the website or the services. Nothing in these terms limits liability that cannot lawfully be limited, including for fraud.
10. Changes
We may update these terms and will revise the “last updated” date above. Continued use of the website after a change means you accept the revised terms.
11. Governing law
These terms are governed by the laws of Singapore, and the courts of Singapore have exclusive jurisdiction over any dispute arising from them.
